Proposition 36 is a California ballot initiative for November 2024. It is a prison spending scam.

We have already started organizing to fight back against this regressive and harmful measure that will fill our prisons and cut resources for important public safety, public health, and rehabilitation programs.

Proponents of the Mass Incarceration Ballot Measure seek to roll back progress that the ACLU and our partners have made to prioritize treatment and services over incarceration for certain drug and theft-related offenses over the past decade.

Prop 36 makes California less safe:

Cuts

Prop 36 will cut hundreds of millions from successful programs, including: 

  • Cuts to mental health and substance abuse treatment 

  • Cuts to trauma recovery services for survivors of crime 

  • Cuts to programs for K-12 public school students. 

Spending

Prop 36 will cost the state billions in new prison and jail spending – the biggest prison spending increase in California history. 

Real problems, wrong solution

Communities are facing real problems, including problems related to substance use, retail theft, housing, and economic hardship. Prop 36 exploits valid community concerns and provides a false, harmful solution.
